The NBS notification form under Article 60 MiCA: content, requirements and the most common shortcomings

On 24 August 2026 the NBS published its own form for the notification of an intention to provide crypto-asset services. It is based on Article 60 of Regulation (EU) 2023/1114 on markets in crypto-assets (the “MiCA Regulation”) and on Commission Implementing Regulation (EU) 2025/304 of 31 October 2024, which lays down standard forms, templates and procedures.
The form has seven parts. Completing it correctly is a precondition for the NBS to assess the notification as complete; until it is complete, the entity may not begin to provide crypto-asset services (Art. 60(8)). The eligible entities are covered in Part 1 of the series.
The short answer
- Legal basis of the form: Implementing Regulation (EU) 2025/304, issued under Art. 60(14) of the MiCA Regulation.
- Content: Parts I–VII — supervisory authority, type of filing, notifying entity, contact and representing persons, notified services, electronic annexes, declaration.
- References to annexes: if the information is in an annex, state the annex number, document name, part and page. A general reference does not suffice.
- Changes: after filing, changes are notified on the same form under Art. 4 of Implementing Regulation 2025/304.
- Electronic annexes: on a durable medium (USB), each with a qualified electronic signature or a qualified electronic seal.
How to complete the NBS notification form: Parts I to VII
In the header of the form the NBS states that specific data are entered in the individual fields. If the information is in an annex, state the annex number, document name, the relevant part and page.
| Part of the form | Content | What to watch |
|---|---|---|
| I. Supervisory authority | NBS, Imricha Karvaša 1, 813 25 Bratislava | pre-filled data |
| II. Type of filing | notification under Art. 60 MiCA or a notification of change under Art. 4 of Implementing Regulation 2025/304 | for a change, state the reference number and date of the original notification, the parts changed and the effect |
| III. Notifying entity | business name, ID No., LEI, registered office and head office, register, website, contacts | also state the trade names, all domains and apps; the register extract as an annex |
| IV. Contact and representing persons | contact person for the NBS, the person responsible for the notification, and any representative | where represented (e.g. by an attorney), attach the power of attorney |
| V. Notified services | marking of services (a)–(j) | for a trading platform also complete point 5.1 (name, address, contacts) |
| VI. Electronic annexes | a proposal to submit annexes on a durable medium (USB) | each annex with a qualified electronic signature or seal |
| VII. Declaration | truthfulness, accuracy, completeness and currency of the data | signed by persons authorised to act for the entity; an undertaking to notify changes |
How to define the notified services in Part V?
Part V contains ten items corresponding to the individual crypto-asset services; the exchange of crypto-assets for funds (point c) and the exchange for other crypto-assets (point d) are marked separately. Each marked service triggers the obligation to submit a further part of the annexes under the NBS checklist — for example custody and administration triggers the custody and administration policy, and execution of orders the order-execution policy.
In practice: mark only the services you actually intend to provide. Every additional service widens the scope of the mandatory annexes and the risk of a request to supplement. It must also be supported by the scope of the sectoral authorisation (Art. 60(3)–(6)).
What undertakings does the entity take on with the declaration in Part VII?
By signing the declaration the entity undertakes to inform the NBS in writing without delay if information concerning the future turns out to be inaccurate, incomplete or misleading. Information with a future date (e.g. planned staffing or the choice of an ICT supplier) should therefore be expressly marked as planned.
How is a change of data notified after the notification?
The notification is not a one-off act. If the data change after filing, the entity files a notification of change under Art. 4 of Implementing Regulation 2025/304 on the same form, with a reference to the original notification — stating the reference number and date of the original, the parts changed and the date the change takes effect.
On what conditions may annexes be submitted electronically?
Part VI of the form allows a proposal to submit the annexes on a durable medium (USB stick). Each annex must bear a qualified electronic signature or a qualified electronic seal based on a qualified certificate issued in a Member State. For an extensive set of policies this is a significant simplification; arranging the qualified signatures, however, should be planned well in advance.
What can be taken from the practice of the Central Bank of Ireland?
The Central Bank of Ireland uses its own template for an Article 60 MiCA notification, based in substance on the same EU-law requirements. Its completion guidance stresses three rules useful for an NBS filing too:
- every answer and every document must refer to a specific part of the form,
- if a question does not apply to the entity, this must be explained,
- the notification is signed by the person responsible for the day-to-day management of the entity.
The first two rules are reflected in the NBS checklist, which has a separate column for the location of the information or the explanation why it is not submitted. The Irish template additionally expressly requires a plan of steps to achieve compliance with Regulation (EU) 2022/2554 (DORA); the NBS checklist does not contain such a separate item.
